NOTICE/TERMS

This web site is provided purely for the promotion of the pictures, paintings, drawings, prints and other products of the Host, Tim Hall and does not provide, nor is intended to provide, any direct facilities for the purchase of such goods and/or services.

You are strongly advised to read the terms and conditions for the purchase of the goods and once you communicate with Tim you shall be deemed to accept such terms despite anything to the contrary stated by your order. A contract will come into effect when:-

• Tim responds by sending an email to you confirming the goods you wish to purchase, or

• If any order requires individual approval by Tim for services supplied or any original commission undertaken when Tim sends an email confirming the order.

• All orders for goods shall be deemed to be an offer by the buyer to purchase the goods in accordance with these conditions.

Acceptance of delivery of the goods by the buyer or representative shall be deemed conclusive evidence of the buyer's acceptance of these conditions.

Delivery

Delivery of the goods shall be through Royal Mail or such other dispatcher as agreed in writing and unless otherwise agreed, at the risk of the buyer (although in the event of any damage, the buyer should notify Tim, explaining the nature of damage and the circumstances in case any replacement or remedial measures can be agreed). Tim will endeavour to dispatch goods within fourteen days upon receipt of payment.

Refund

In the unlikely event that the picture, print or such item is not to the customer's liking, a full refund of the purchase price (less an administrative charge) shall be made upon receipt of the said goods from the customer subject to their receipt in good condition (and the customer shall be responsible for all costs incurred when returning via Royal Mail Special Delivery or such other means as previously agreed in writing with Tim).

Purchasers from abroad wishing to purchase goods are more than welcome to contact Tim to discuss – preferred payment would be via client sending an International Banker's Draft drawn in sterling on a London bank for Tim.

Commissions

Any commission undertaken by Tim would be subject to the prior payment of a deposit of 33% of the agreed price, the deposit will be offset as part payment upon final invoicing of the client for the completed commission. Please note that commission prices vary according to the projected work undertaken, and will be the subject of individual negotiation with Tim. (In the unlikely event that a completed commission is declined by the client, please note the deposit is not refundable.)

Any dispute arising under these conditions or from goods and/or services provided shall be governed by English Law.
